Arboricultural Statements of Evidence and Expert Reports

When a tree is at the centre of a dispute, appeal or insurance claim, you need evidence that is independent, rigorous and clearly reasoned.

Mathew Phillips has written expert reports for the NSW Land and Environment Court and adheres to the Expert Witness Code of Conduct (Schedule 7 of the Uniform Civil Procedure Rules 2005 (NSW), r 31.23), which the Court applies to every expert. That means an overriding duty to assist the Court impartially, not to advocate for the party who engages us.

  • Thorough site inspection and measurement, including GNSS positioning down to 1 cm and LiDAR 3D root mapping where roots are in question
  • Risk assessment using Advanced QTRA or ISA TRAQ
  • Assessment against AS 4970:2025, AS 4373-2007 and the relevant council controls
  • A clear, impartial report and statement of evidence that complies with the code's content requirements, including an acknowledgment that the code has been read and agreed to
  • Experience across Sydney LGAs, including councils' own projects

Who it's for: solicitors, councils, strata committees, insurers and property owners.
